Sheriff Sales

Documents required for a Writ of Execution/Real Estate & Mortgage Foreclosure:

  1. $2500.00 Deposit fee
  2. Writ for Sheriff
  3. Writ for each Defendant
  4. Pa.R.C.P. NO.3129.1 Affidavit 
  5. Pa.R.C.P. NO.3129.2 Notice of Sale one copy for Sheriff and each Defendant
  6. Hard copy or Electronic version of the long legal description including the current derivation clause e-mailed to jcampbell@perryco.org or sfritz@perryco.org
  7. Short legal description for Advertising
  8. UNIFORM PARCEL IDENTIFICATION NUMBER (UPI): legal description MUST INCLUDE tax parcel number(s) and be in the correct format xxx,xxx.xx-xxx.xxx and include the docket number
  9. Instruction forms listing service address(s) for each Defendant and the property to be posted. Also, list the date the property is to be sold.
  10. Service of Lienholders to be made by the Plaintiff and that proof of service of Lienholders to be filed with Protonotary prior to the sale. 

Post-Sale Requirements Third Party Sales:

  1. The Successful third party bidder is required to pay 10% deposit of the purchase price and 2% poundage 
  2. The deposit must be paid to the Sheriff immediately after the conclusion of the Sheriff’s sale by the successful bidder on each property. Deposit can be made payable by cash, check, certified check or money order made payable to the Sheriff of Perry County.
  3.  Terms of Sale: 10% of purchase price to be paid or total costs plus poundage whichever is greater when the property is stricken down, and the balance is due in 10 days. If the balance is not paid in 10 days, you will lose your down payment. 
  4. Realty transfer taxes of 2% of the purchase price will be added to plaintiff’s costs if the transaction is not tax exempt and poundage of 2% of the purchase price up to $250,000 (plus .5% of any remaining bid price) will be added to the successful bidder’s costs.
  5. The deposit paid by any bidder who fails to comply with the above conditions shall be forfeited.
  6. Bidders are responsible to research the title to the property being sold prior to the sale.
  7. Deeding Assignment- The successful bidder must provide the name and address of the party to whom the property is to be conveyed to.
  8. (2) Realty Transfer tax statement of Value(REV-183) (completed and signed) attached with a copy of the Mortgage and 1 self-addressed stamped envelope for the return of the original deed.
